Welcome to Smoky Mountain Sand & Gravel. These Terms of Service (the “Terms”) govern your use of our website at smokymountainsg.com (the “Site”) and the services we provide at our drop-off yard in Maryville, Tennessee. Please read them carefully.

1. Acceptance of these Terms

By using our Site, logging into our portal, opening a contractor account, or dropping off material at our yard, you agree to these Terms. If you do not agree, please do not use the Site or our services. If you are using our services on behalf of a company, you represent that you have authority to bind that company to these Terms.

2. About us

Smoky Mountain Sand & Gravel (“SMSG,” “we,” “us,” or “our”) operates a concrete and asphalt drop-off yard serving contractors and homeowners in East Tennessee. You can reach us at:

3. Use of the Site

The Site provides information about our yard, accepted materials, pricing, service area, and hours. It also hosts a secure portal where contractor-account holders can log in to view tickets, review invoices, and manage their account.

You agree to use the Site only for lawful purposes. You agree not to interfere with the Site’s operation, attempt to access areas you’re not authorized to use, or use automated tools to scrape or harvest content.

4. Contractor accounts

We offer contractor accounts with Net-15 or Net-30 invoice terms to qualifying businesses. If you apply for an account:

  • You must be at least 18 years old and authorized to act on behalf of your company.
  • You’re responsible for providing accurate, current, and complete business information, and for keeping it up to date.
  • Credit terms are subject to review. We may request a trade or credit reference before approving an account, and we may adjust credit limits or terms at any time based on payment history.
  • You’re responsible for keeping your portal login credentials confidential. Activity under your login is treated as authorized by you. Notify us right away if you believe your credentials have been compromised.
  • We may suspend or close an account for nonpayment, misuse, repeated contamination issues, abusive behavior toward staff, or any other reason we reasonably determine is necessary to protect our operations or other customers.

5. Materials — what we accept and what we reject

What we accept. We generally accept clean construction and demolition material, including:

  • Concrete (with or without light rebar, subject to inspection)
  • Asphalt millings and asphalt chunk
  • Brick and block
  • Natural stone
  • Clean fill dirt

Specific acceptance criteria and size limits are posted at the yard and on our website. Every load is subject to inspection on arrival.

What we reject. We do not accept:

  • Household trash or garbage
  • Hazardous materials, including solvents, paint, fuel, oil, asbestos, and chemically treated material
  • Liquids of any kind
  • Tires, appliances, furniture, electronics
  • Vegetation, stumps, or yard waste
  • Drywall, insulation, or roofing shingles
  • Any material we reasonably determine is unsafe to accept

Final acceptance or rejection of any load is at our discretion. If you bring a load we reject, you’re responsible for removing it from our property and disposing of it lawfully.

Contamination surcharges. If an otherwise acceptable load contains trash, rebar beyond normal levels, or other contamination, we may (a) reject the load, (b) accept it with a contamination surcharge, or (c) require you to sort the load before unloading. Contamination surcharges are posted at the yard and may be updated at any time.

Pricing. We charge a flat rate by vehicle type (from pickup trucks up through tri-axle dumps). Posted rates at the yard control at the time of drop-off. Rates are subject to change without notice. Quotes provided by phone, email, or on the Site are estimates and do not override the rates posted at the yard.

6. Availability and hours

Our yard is generally open Monday through Saturday, sunrise to sunset. We do not take appointments and we don’t guarantee availability at any particular time. We may close early or temporarily stop accepting loads due to weather, ground conditions, yard capacity, equipment issues, staffing, or any other operational reason. Check the Site or call ahead if conditions are uncertain.

7. Payment terms

We accept cash, major credit and debit cards, and charges to approved contractor accounts. Credit-card surcharges, if any, are disclosed at the scale.

Contractor-account invoices are due on the terms printed on the invoice (Net-15 or Net-30). Balances unpaid past the due date may accrue a late fee and finance charges at the maximum rate allowed by Tennessee law. Accounts in arrears may be placed on hold, and we may require payment at drop-off until the balance is current. If we refer a past-due account for collection, you’re responsible for reasonable collection costs and attorneys’ fees to the extent permitted by law.

8. Intellectual property

The Site, including its text, graphics, logos, photography, and layout, is owned by Smoky Mountain Sand & Gravel or our licensors and is protected by U.S. copyright and trademark law. You may view and print pages for your personal or internal business use. You may not copy, republish, scrape, resell, or commercially exploit any content from the Site without our written permission. “Smoky Mountain Sand & Gravel” and our logo are our trademarks.

9. Disclaimers

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent allowed by Tennessee law. We do not warrant that the Site will be uninterrupted, error-free, or free from viruses or other harmful components.

Material descriptions, gradations, and photos on the Site are approximate. Actual material characteristics vary load to load.

You’re responsible for complying with the laws, permits, and regulations that apply to your own work, including DOT weight limits on your vehicle, load securement, job-site disposal rules, and any local permitting requirements for material sourced from or taken to your site. We are a drop-off yard; we do not advise on, supervise, or assume responsibility for the legal or regulatory compliance of your project.

10. Limitation of liability

To the fullest extent permitted by Tennessee law, Smoky Mountain Sand & Gravel and its owners, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, business interruption, or cost of substitute services, arising out of or related to your use of the Site or our services, even if we’ve been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or related to a specific service we provided to you will not exceed the amount you actually paid us for that specific service. Some jurisdictions do not allow certain limitations; to the extent a limitation above is not enforceable, it applies to the maximum extent the law allows.

11. Indemnification

You agree to defend, indemnify, and hold harmless Smoky Mountain Sand & Gravel and its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or our services, (b) your breach of these Terms, (c) material you bring to our yard that is misrepresented, contaminated, or unlawful to dispose of, or (d) your violation of any law or the rights of any third party.

12. Governing law and venue

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute arising out of or related to these Terms or our services will be the state or federal courts located in Blount County, Tennessee, and you consent to the personal jurisdiction of those courts.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll revise the effective date at the top of this page. For material changes, we’ll also note the change so it’s visible to account holders. Your continued use of the Site or our services after the effective date means you accept the updated Terms. If you don’t agree to the updates, please stop using the Site and let us know so we can close your account.
